Legal terms and conditions for using CardProof

1. Acceptance of Terms

By accessing or using CardProof ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

CardProof provides a proof-of-possession verification service for physical collectibles. The Service allows users to create time-stamped records demonstrating possession of specific items at specific times. IMPORTANT DISCLAIMERS: • CardProof does NOT verify authenticity of items • CardProof does NOT verify ownership or legal title • CardProof does NOT appraise or value items • CardProof does NOT guarantee the accuracy of user-provided information • Proof records demonstrate POSSESSION only, not ownership or authenticity

3. User Accounts

To use certain features of the Service, you must create an account. You agree to: • Provide accurate and complete registration information • Maintain the security of your account credentials • Notify us immediately of any unauthorized account access • Be responsible for all activities under your account We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. User Conduct

You agree NOT to use the Service to: • Create fraudulent or misleading proof records • Misrepresent possession, ownership, or authenticity of items • Upload manipulated or digitally altered images • Violate any applicable laws or regulations • Infringe on intellectual property rights of others • Harass, abuse, or harm other users • Attempt to circumvent security measures • Use the Service for any illegal purpose Violations may result in immediate account termination and may be reported to appropriate authorities.

5. User Content

You retain ownership of content you upload to the Service ("User Content"). By uploading User Content, you grant CardProof a non-exclusive, worldwide, royalty-free license to use, store, and display your content as necessary to provide the Service. You represent that you have all rights necessary to upload User Content and that your content does not violate any laws or third-party rights. We may remove User Content that violates these Terms without notice.

6. Intellectual Property

The Service, including its design, features, and functionality, is owned by CardProof and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission. The CardProof name, logo, and related marks are trademarks of CardProof. You may not use these marks without permission.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDPROOF SHALL NOT BE LIABLE FOR: • Any indirect, incidental, special, or consequential damages • Loss of profits, data, or business opportunities • Reliance on proof records by third parties • Fraudulent activity by other users • Accuracy of user-provided information Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless CardProof, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from: • Your use of the Service • Your User Content • Your violation of these Terms • Your violation of any third-party rights

9. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination: • Your right to use the Service will immediately cease • Your proof records will be marked as revoked • We may delete your User Content Sections of these Terms that should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
