CardProof™ Legal Terms & Disclosures

These terms govern your access to and use of CardProof™ and the services available at cardproof.io.

1. Purpose of CardProof™

CardProof™ provides a neutral technical system for generating, displaying, and verifying system-generated records associated with physical items that are presented to the CardProof™ system by users at a specific point in time. CardProof™ does not determine, certify, or guarantee legal ownership, title, authenticity, value, condition, grade, or provenance of any item.

2. Proof of Possession Records

A CardProof™ record reflects that: • A physical item was presented to the system by a user • The user asserted possession or control of the item at the time of capture • The item was captured and recorded using CardProof™ tools • A timestamped system record was generated A CardProof™ record does not represent or guarantee: • Legal ownership or title • Authenticity or originality • Grade, condition, completeness, or market value • Provenance prior to the record timestamp • Continued possession, custody, or control after record creation All records are informational only and reflect circumstances at the time of capture.

3. No Authentication, Grading, or Appraisal

CardProof™ is not an authentication service, grading service, appraisal service, escrow provider, custodian, or marketplace. CardProof™ does not perform expert inspections or professional evaluations, including those typically conducted by third-party grading or authentication organizations. Any imagery, metadata, analysis, or identifiers displayed by CardProof™ are provided solely for informational and recordkeeping purposes and should not be relied upon as professional determinations.

4. Verification Results and Missing Records

If a Proof ID or verification link does not exist in the CardProof™ system, no record will be returned. CardProof™ does not generate placeholder records, inferred matches, probabilistic verifications, or partial results. The absence of a record does not, by itself, indicate fraud, authenticity, ownership status, or wrongdoing. It only indicates that no corresponding record exists in the CardProof™ database.

5. User Responsibilities

Users are solely responsible for: • The accuracy and completeness of submitted information • The physical items they present to the system • Maintaining custody or control of items after record creation • Sharing correct, complete, and unaltered verification links • Compliance with applicable laws, regulations, and marketplace rules CardProof™ does not monitor, facilitate, or enforce private transactions between parties.

6. Transfers, Revocation, and Invalidation

Records may be transferred, restricted, revoked, or invalidated under certain circumstances, including but not limited to: • User-initiated transfers • Reported disputes or claims • Detected misuse, manipulation, or policy violations • Actions required to preserve system integrity Such actions may be taken in CardProof™'s reasonable discretion and in accordance with applicable law and platform policies.

7. Third-Party Use and Reliance

Buyers, sellers, marketplaces, and other third parties access CardProof™ information at their own risk. CardProof™ makes no representations or warranties regarding how third parties interpret, rely upon, or use CardProof™ records. All transaction decisions and risk assessments remain solely between the parties involved.

8. No Warranties

CardProof™ is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, CardProof™ disclaims all warranties, express or implied, including but not limited to warranties of: • Merchantability • Fitness for a particular purpose • Accuracy, completeness, or reliability of records • Non-infringement

9. Limitation of Liability

To the fullest extent permitted by law, CardProof™ shall not be liable for: • Losses arising from reliance on CardProof™ records • Disputes between buyers and sellers • Market value fluctuations • Fraud, misrepresentation, or third-party conduct • Indirect, incidental, consequential, or special damages Except where prohibited by law, CardProof™'s total aggregate liability for any claim shall not exceed the lesser of: • The amount paid to CardProof™ for the applicable service, or • One hundred U.S. dollars (USD $100) This limitation does not apply to liability resulting from CardProof™'s willful misconduct or gross negligence where such exclusions are not permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless CardProof™, its officers, directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: • Your use of the platform • Items or information you submit • Your transactions or representations • Your violation of these terms or applicable law This indemnification does not apply to claims arising solely from CardProof™'s willful misconduct or gross negligence.

11. Data, Records, and Auditability

CardProof™ may retain records related to proof creation, verification attempts, transfers, and system activity for security, audit, compliance, and operational purposes, subject to applicable law and the CardProof™ Privacy Policy. Such records do not constitute legal documentation of ownership or title.

12. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

13. Changes to These Terms

CardProof™ may update these terms from time to time. Continued access to or use of the platform constitutes acceptance of the updated terms.
